SBA Updates Eligibility Requirements for Borrowers With Previous Defaults
SBA now may waive prior-loss eligibility bars on 7(a) and 504 loans for passive minority investors who meet all three criteria: owned <20% of the prior business, were not a guarantor or co-borrower on the defaulted loan, and had no control over the business that caused the loss. Waivers are not automatic. SBA reviews them case-by-case under its Fraud Risk Framework, evaluating factors like prior involvement, timing, number of losses, and investment size relative to the loan, and this only applies to 7(a)/504 losses, not PPP, COVID EIDL, or other federal defaults.
